1. Who we are and what these terms cover

PredicTCG is operated by Bruno Severini, a self-employed professional (libero professionista), VAT number IT18743751002, Via Giannutri 10, 04016 Sabaudia (LT), Italy ("PredicTCG", "we", "us"). Contact: contacts@predictcg.com.

These terms apply to the PredicTCG app and to predictcg.com. By creating an account or using PredicTCG you agree to them. The terms of the App Store or Google Play also apply to how you download the app and pay for PRO. How we handle personal data is explained in our Privacy Policy.

2. Who can use PredicTCG

• You must be at least 13 and old enough to agree to the use of your data in your country (for example 14 in Italy and 16 in Germany). If you are under 18, you need the permission of a parent or guardian.
• One account per person. Keep your login safe: you are responsible for what happens with your account.
• Give us accurate information and keep it up to date.

3. What PredicTCG does

PredicTCG helps you follow and value trading cards: prices taken from completed sales, your collection, a grading scanner that estimates a card's grade from your photos, market data, forecasts of future prices, alerts and a community of collectors. We keep improving PredicTCG, so features may change over time.

4. Estimates, not advice

Prices are estimates built from past sales, which can contain errors or move quickly. Forecasts are statistical estimates of what may happen, with the confidence and risk we measure; they are not promises. A grade from our scanner is an estimate from your photos, not an official grade from PSA, BGS, CGC or any other grading company.

Nothing in PredicTCG is financial, investment or tax advice. Decisions to buy, sell, keep or grade cards are yours. Please check what matters to you before you decide.

5. The free plan and PRO

Free plan

The free plan includes prices, your collection, markets, the collectors community, the five-year forecast view and 10 grading scans a month. Scans of graded cards in their slab are free and don't count toward the monthly scans.

PRO subscriptions

• PRO is offered as a monthly or yearly subscription. In the United States it costs $9.90 a month or $99 a year; prices in other countries may differ. The price, currency and any taxes are shown in the App Store or Google Play before you buy.
• Payment is charged to your App Store or Google Play account when you confirm the purchase.
• Your subscription renews automatically for the same period and price unless you turn off auto-renew at least 24 hours before the current period ends. Your account is charged for the renewal within the 24 hours before the period ends.
• You can manage or cancel your subscription in your App Store or Google Play account settings. Deleting the app or your PredicTCG account does not cancel it.
• When you cancel, PRO stays active until the end of the period you have paid for.
• If we change the price, the App Store or Google Play informs you before it applies, as their rules require.
• If we offer a free trial or an introductory price, its terms are shown before you buy. Any unused part of a free trial ends when you buy a subscription.

Refunds and withdrawal

PRO is sold and billed by Apple or Google, so refund requests are handled by them under their policies. If you are a consumer in the European Union or the United Kingdom, you may have a legal right to withdraw from a purchase within 14 days; you exercise it through Apple or Google.

Predicter One

The first 400 people to start a yearly PRO subscription receive a numbered Predicter One badge. It is a collectible badge on your profile: it has no monetary value and can't be transferred or sold. It stays on your profile for good.

6. Your content and your public profile

• What you add to PredicTCG stays yours: your profile, photo, collection and scans.
• You allow us to store, process and show that content as needed to run PredicTCG, for example to show your public profile to other collectors or to create the images you choose to share. This permission is worldwide and free of charge, and it ends when you delete the content or your account, except for copies we keep as described in the Privacy Policy.
• Your profile stays private until you choose to make it public. Your collection's values are shown only if you choose.
• Don't post anything illegal, offensive, hateful or sexual, don't pretend to be someone else, don't share other people's personal data and don't spam or scam. You are responsible for what you share.
• You can report content and block other users. We may remove content or limit accounts that break these rules.

7. Fair use

Please don't:

• copy, scrape or collect our data, prices or forecasts with automated tools, or resell them;
• reverse engineer the app, except where the law allows it;
• try to break, overload or get around the security of PredicTCG;
• create several accounts to get more free scans, or misuse the free plan in other ways.

8. Our content and other brands

The app, the website, their design and software, and our prices, data compilations, forecasts and scores belong to us or to our licensors. You may use them for your own personal, non-commercial purposes.

Card names, images and logos belong to their owners, such as The Pokémon Company, Wizards of the Coast, Konami, Bandai, Disney and Riot Games. We show them only to identify cards. PredicTCG is not affiliated with, sponsored or endorsed by any of them.

9. Availability and changes

We work to keep PredicTCG available and accurate, but we provide it "as is" and "as available". We may change, suspend or end features. If a change takes away an important part of what you pay for in PRO, we tell you in advance.

10. Liability

As far as the law allows, we are not liable for indirect or consequential losses, lost profits, or decisions you make based on prices, forecasts or grade estimates. Our total liability to you is limited to the amount you paid for PredicTCG in the 12 months before the claim.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, or any other liability that the law does not allow us to limit. Your rights as a consumer under the law are not affected.

11. Ending your account

You can stop using PredicTCG at any time and delete your account in the app, in Profile › Delete account. We may suspend or close an account that seriously or repeatedly breaks these terms, telling you why when we reasonably can.

12. Changes to these terms

We may update these terms. If the changes are important, we tell you in the app or by email before they apply. If you don't agree, you can stop using PredicTCG and delete your account; a PRO subscription you have already paid for continues until the end of its period.

13. Law and disputes

These terms are governed by Italian law. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim before the courts where you live. Otherwise the courts of Rome, Italy, have jurisdiction. If something goes wrong, please write to us first: most problems are solved quickly that way. Consumers in the European Union can also turn to an alternative dispute resolution body in their country.

14. App Store and Google Play

These terms are between you and us, not Apple or Google. If you downloaded the app from Apple's App Store, these points also apply:

• We grant you a non-transferable licence to use the app on Apple-branded devices that you own or control, as allowed by the App Store's Usage Rules.
• We, not Apple, are responsible for the app, its content, maintenance and support. Apple has no obligation to provide maintenance or support for it.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
• We, not Apple, are responsible for handling any claims about the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection claims.
• If anyone claims that the app infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a US Government embargo or designated as "terrorist supporting", and that you are not on any US Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
